Service Terms

Service Terms

These Service Terms apply to services provided by Peaceable Mediation and Community Solutions Inc. (“Peaceable”).

They form part of the agreement between Peaceable and the person or organization receiving or purchasing Peaceable services.

Some services may also be governed by a proposal, engagement agreement, mediation agreement, statement of work or other written agreement. Where additional or service-specific terms are provided, those terms form part of the agreement for that service. If there is a conflict between these Service Terms and a service-specific written agreement, the service-specific agreement will apply to the extent of that conflict.

1. Peaceable Services

Peaceable provides professional services in mediation, conflict management, conflict coaching, facilitation, organizational conflict assessment and related advisory work.

The scope, format, timing, deliverables and fees for a particular service may be described on the Peaceable website, in an online form, proposal, booking confirmation, engagement agreement or other written communication provided by Peaceable.

Where a service includes practitioner review, analysis, facilitation, mediation, coaching, assessment or preparation of a written deliverable, that professional work forms part of the service provided.

2. Fees and Payment

Fees for Peaceable services will be communicated before the service is purchased or confirmed.

Applicable taxes will be added where required.

Depending on the service, payment may be made through an online payment process, invoice or another payment arrangement agreed with Peaceable.

Peaceable may waive or reduce a fee at its discretion. A waived or reduced fee does not change the nature of the service provided or the application of these Service Terms.

Where a proposal, engagement agreement or other service-specific document includes different payment, deposit, cancellation or refund terms, those terms will apply to that service.

3. Client Information

Peaceable relies on the information provided by clients and participants in order to understand the circumstances, prepare for services and carry out its professional work.

You are responsible for providing information that substantially reflects your own knowledge, experience and understanding.

Where Peaceable requests information about other people, please provide only the personal information reasonably necessary for the service and avoid identifying individuals where their identity is not necessary to understand the situation.

You retain ownership of the information, documents and responses you provide to Peaceable.

4. Privacy and Confidentiality

Personal information provided to Peaceable will be handled in accordance with Peaceable’s Privacy Policy and any confidentiality arrangements that apply to the particular service.

Peaceable may use third-party service providers to support functions such as form hosting, payment processing, secure storage, communications and administration. These providers may process information on Peaceable’s behalf as necessary to provide those services.

Where a particular service involves additional confidentiality arrangements, including mediation, organizational assessment or work involving multiple participants, those arrangements may be set out separately before the service begins.

5. Intellectual Property

Peaceable retains its rights and interests in the materials, methodologies, frameworks and tools it develops and uses in providing its services.

These may include assessment questions, wording, structures, sequencing, methodologies, interpretive frameworks, practitioner tools, assessment architecture, workshop and facilitation materials, report structures, templates and other Peaceable-created materials.

Unless Peaceable provides written permission otherwise, Peaceable materials may not be copied, recorded, reproduced, published, distributed, adapted, shared for use by others, incorporated into another commercial service or methodology, or used to develop, train or reproduce another tool, assessment, program or service.

Where Peaceable provides a report, written deliverable or other material specifically for you, you may retain and use that deliverable for your own personal or internal organizational purposes unless a different written agreement applies.

Your right to use a Peaceable deliverable does not transfer ownership of the underlying Peaceable methodology, framework, assessment instrument, practitioner tools or other proprietary materials used to create it.

6. Conflict Capability Snapshot

The following additional terms apply to the Peaceable Conflict Capability Snapshot.

The Service

Each completed Peaceable Conflict Capability Snapshot is individually reviewed and analysed by a Peaceable practitioner.

Your practitioner considers your responses together, looks for relevant patterns, capabilities, tensions and questions, and prepares a personalized written Snapshot report based on the information you have provided.

The Snapshot reflects the perspective and information contained in your responses. It is designed to provide insight into how conflict is experienced and managed from where you sit and to identify areas that may deserve further attention or exploration.

Delivery

Your completed report will be sent to the email address you provide within 10 business days after Peaceable receives your completed submission and any applicable service fee.

Your Responses

The value of the Snapshot depends on your own account of your experience. Please answer the questions in your own words and based on what you have observed, experienced or understood.

Peaceable’s practitioner analysis relies on the language, distinctions, examples and context you provide. By submitting your Snapshot, you confirm that your responses substantially reflect your own experience and thinking.

Generative artificial intelligence tools should not be used to generate, interpret, expand or substantively rewrite your responses.

Spelling, grammar, translation, dictation and accessibility tools may be used where they help you express your own response without changing its substance.

Assessment questions or other Peaceable assessment materials may not be entered into generative AI systems for the purpose of generating answers, analysing or reproducing the assessment, developing another assessment or methodology, or otherwise using Peaceable’s assessment materials beyond completing your own Snapshot.

Practitioner Review and Preparation of Your Report

The Snapshot service includes the practitioner work involved in reviewing your responses, analysing the information provided, considering relationships among your responses and preparing your personalized written report.

The report is prepared from the information available to Peaceable through your completed Snapshot. Where a response does not provide sufficient information to support a conclusion, Peaceable may identify a question, uncertainty or area requiring further exploration rather than drawing a broader conclusion.

Cancellations and Refunds

You may request cancellation and a full refund at any time before Peaceable begins practitioner review of your submitted responses.

Once practitioner review has begun, the service fee is non-refundable because the professional review and analysis forming the service are already underway.

If Peaceable is unable to complete your Snapshot after accepting your submission, any service fee paid for the uncompleted service will be refunded.

Nothing in these Service Terms limits any right or remedy available to you under applicable consumer protection law.

Use of Snapshot Materials

Access to the Peaceable Conflict Capability Snapshot is provided for the purpose of completing your own assessment.

Without Peaceable’s prior written permission, the assessment questions or materials may not be copied, recorded, reproduced, published, distributed, adapted, shared for use by others, administered as another assessment, incorporated into another assessment or methodology, uploaded to an artificial intelligence system, or used to develop, train or reproduce another assessment tool or service.

You may save, copy and share your completed Snapshot report for your own personal or internal organizational purposes.

Peaceable retains ownership of the underlying assessment methodology, questions, frameworks, practitioner tools, assessment architecture and report design contained within or used to produce the report.

7. Service-Specific Agreements

Some Peaceable services require additional agreements because of the nature of the engagement, the people involved or the confidentiality and reporting arrangements that apply.

These may include mediation agreements, organizational assessment agreements, facilitation or consulting engagements, coaching agreements, proposals or statements of work.

Any additional terms will be provided before or as part of the relevant service engagement and will apply together with these Service Terms.

8. Changes to These Terms

The Service Terms that apply to a service are the terms in effect when that service is purchased, booked or otherwise agreed.

Peaceable may update these Service Terms for future services or engagements.

Changes made after you enter into an agreement with Peaceable will not alter the terms that previously applied to that engagement unless you and Peaceable agree otherwise.

9. Governing Law

These Service Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

10. Severability

If a court, tribunal or other authority with jurisdiction determines that a provision of these Service Terms is invalid, illegal or unenforceable under applicable law, that provision will be interpreted or limited only to the extent necessary to address that issue.

The remaining provisions will continue to apply.
